1. Service Agreement
TestCert is a cloud-based SaaS platform for managing industrial test certificates, developed and operated by Techgate Solutions Pvt Ltd ("Techgate", "we", "us"). By registering and using TestCert you agree to be legally bound by these Terms of Use. Users acting on behalf of an organisation confirm they have authority to bind that organisation.
Buyer/Manufacturer organisations must be approved by Techgate before accessing the platform. Supplier and Inspector users may register and participate once invited by an approved organisation.
2. User Accounts & Security
TestCert uses email OTP (one-time password) authentication — no passwords are stored. Each user licence is tied to a specific email address. Sharing login credentials within or outside your organisation is strictly prohibited and may result in immediate account suspension.
Users are solely responsible for maintaining the security of their registered email account. Notify us immediately at support@testcert.co if you suspect unauthorised access.
3. Roles & Permissions
Access to TestCert features is governed by a five-role permission model: Super Admin, Org Admin, Quality Manager, Inspector, and Read-Only Viewer. Org Admins are responsible for assigning appropriate roles to their users. All data access is isolated per organisation — no cross-tenant data access is permitted.
4. Certificate Data & Document Integrity
Certificates in Approved or Released state are immutable. Every read and write operation generates an audit log entry. Users acknowledge that submitted certificate data constitutes a representation of the material properties and test results of the goods described, and must be accurate and complete.
Techgate is a software platform provider only. We make no representations regarding the accuracy of certificate data entered by users. Verification and acceptance of incoming certificates remain the sole responsibility of the receiving organisation.
5. Licence Fees & Payments
Subscription fees are as displayed on testcert.co or as agreed in writing. Licences are per organisation and may not be transferred. Annual licences are non-refundable after acceptance. Techgate reserves the right to suspend access for non-payment after 15 days past the due date.
6. Support & Training
Techgate provides support via email, live chat, and documentation. Technical support is available to authorised users of subscribed organisations. Additional consultancy services beyond standard support require a separate written agreement.
7. Acceptable Use
Users must not:
- Upload false, fraudulent, or fabricated certificate data
- Attempt to access another organisation's data
- Reverse-engineer, decompile, or attempt to extract the platform source code
- Use the platform for any unlawful purpose or in violation of applicable standards
- Introduce malware, viruses, or disruptive code
Techgate reserves the right to suspend or terminate any account found in violation of these rules, without prior notice.
8. Disclaimer
TestCert is provided as a software tool to facilitate certificate management workflows. Techgate is not responsible for decisions made based on certificate data processed through the platform. Techgate does not act as a certifying authority, inspector, or quality assurance body. Users are responsible for compliance with applicable industry standards (ASTM, ASME, EN, API, IS, NORSOK, AWS, NACE, and others).
9. Liability
To the maximum extent permitted by law, Techgate shall not be liable for any indirect, consequential, or incidental loss arising from use of or inability to use the TestCert platform. Techgate's total aggregate liability shall not exceed the fees paid by the affected organisation in the 12 months preceding the claim.
Techgate targets 99.9% monthly platform availability. In the event of a shortfall, affected subscribers may be entitled to a proportional credit at Techgate's discretion.
10. Confidentiality
All certificate data and organisational information submitted to TestCert is treated as confidential. Techgate will not disclose your data to third parties except as required by law or as described in our Privacy Policy. Users agree to treat any non-public information about Techgate's platform as confidential.
11. Contract Termination
Either party may terminate this agreement with 30 days written notice. Techgate may terminate immediately for breach of these Terms. Upon termination, your access to the platform ceases. Certificate data subject to regulatory retention will be preserved for the required period; other data will be deleted or returned within a timeframe communicated by Techgate.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Gujarat, India. Any disputes shall be subject to the exclusive jurisdiction of the Baroda District Court. By using TestCert, you consent to this jurisdiction.
13. Changes to These Terms
Techgate reserves the right to update these Terms at any time. Users will be notified by email and at login. Continued use of the platform after the effective date constitutes acceptance of the revised Terms. Users who do not accept the revised Terms may terminate their account within 30 days of notification without breach.
